Lawyers are well aware of the ever-growing trend toward settling cases, rather than risking the uncertainty of trial. Studies show that the number of trials is decreasing by double-digit percentages each decade. Never ones to accept a trend at face value, we decided to see if all cases are following the same course. The answer is no, at least in terms of cases reported to VerdictSearch. The accompanying chart depicts the year-by-year ratio of verdicts we've reported, in relation to settlements. Keep in mind that we've always reported far more verdicts than settlements, given the confidential nature of settlements. But in the past five years, we've seen a more than 100 percent increase in the verdict-to-settlement ratio of million-dollar cases, as represented by the green line, while sub-million-dollar cases have the exact same ratio as they did in 2004. So if our universe of case reporting is reflective of the actual landscape, attorneys seem increasingly willing to risk a trial when a seven-figure reward awaits.
