Bagel Shop Ruled Not Liable for Worker Who Punched Patron
The operators of a bagel shop in Manhattan are not
liable for the actions of a kitchen worker who punched a patron after the
customer used a vulgarity at a waitress, a Supreme Court justice concluded.

Edmead held that Nathan Bershadsky was not acting within his
capacity as an employee of Tompkins Square Bagels—even as loosely defined as
his job appeared to be—when he followed patron Edgar Villongco outside of the
shop and across the street and punched him in the jaw.
