If you've ever needed to get a valuation on something for taxation purposes (Если когда-нибудь Вы будите  нуждаться в оценке чего-либо в целях налогообложения), you'll know it can be a costly and time-consuming business (Вы должны понимать, что это может быть затратным и трудоемким делом). Not only does market value go up and down (Не только рынок влияет на повышение и понижение цен), but what constitutes a fair valuation is also open to challenge by the ATO (ведь то, что, казалось бы, правильно оценено может быть исправлено налоговым органом). 

In today's Smart Tax Bulletin, our Editor-in-Chief, John Kelly, (В сегодняшнем Smart Tax Bulletin наш главный редактор  John Kelly) will take us through the details of the Inspector General of Taxation's recently announced review of the ATO's valuations procedures (посвятит нас в делали опроса Налоговой службы, посвященного процедуре оценки). It is hoped the review will result in a fairer and easier valuation process all round (Мы надеемся, что этот опрос в результате поможет сделать процесс оценки правильнее и проще во всех его аспектах).

Inspector General of Taxation to review the ATO's administration of valuations (Главный налоговый инспектор выносит на обсуждение вопросы, связанные с администрированием процесса оценки)

The tax law has become increasingly reliant on the use of market value in working out whether something is taxable or the extent to which it is taxable (Налоговое законодательство стало все больше вмешиваться в корректировку рыночных цен, когда речь идет о налогообложении чего-либо либо о степени такого налогообложения). Valuations can be required for many reasons (Оценка может требоваться по различным причинам), including when business owners need to work out (включая случаи когда владельцы предприятий  вынуждены решать) whether they are entitled to the small business capital gains tax concessions (имеют ли они право применять льготы для малого бизнеса по налогу на прирост капитала) and when transferring assets between related parties (либо когда происходить передача активов между зависимыми лицами). 

The tax law may require you to value an asset, a transaction, a business or a liability (Налоговое законодательство может требовать оценки активов, сделки, предприятия или даже ответственности) . Getting these valuations can be a costly and time-consuming process (Осуществление процедуры указанных оценок может стать затратным и трудоемким процессом). 

The Inspector General of Taxation has recently announced a review of the ATO's administration of valuations (Главный налоговый инспектор недавно предложил  провести обсуждение, связанное с администрированием процесса оценки Налоговой службой Австралии). This review has arisen out of concern over the burden valuation requirements place on taxpayers (Данный обзор возник из-за опасения наложения бремени оценки на налогоплательщиков), especially given that many valuations will include a degree of judgement and are open to legal challenge by the ATO (и особенно из-за того, что оценка во многих случаях может быть сделана на основании определенной степени суждения и открыта для права Налоговой службы изменить ее результат ), resulting in more time and further costs (ведущее в результате  к потере времени и соответственно  неоправданным затратам). 

If you have had a run-in with the ATO on a valuation matter or you have a view on how the ATO administers valuation matters, you can now have your say (Если у Вас уже был спор с Налоговой службой, связанный с вопросами оценки или Вы имеете свое мнение в отношении того как налоговая служба должна осуществлять администрирование по вопросам оценки, то у Вас есть сейчас возможность высказать свое мнение) . The terms of reference of the review can be found on the (Условия проведения обсуждения можно найти на) Inspector General of Taxation's website. Submissions close on 20 December 2013 (Предложения принимаются до 20 декабря 2013 года).
