Employment contracts will often contain provisions for a probationary period (Трудовой договор часто встречает и будет встречать содержание условий об испытательном сроке) – an initial period of service during which time both you and the employee (начальный период работы в течение которого Вы и Ваш работник, каждый сам для себя,) can decide whether you want the employment to continue (можете решить должно ли продолжатся трудоустройство (действие трудового договора)).

This gives you an opportunity to assess the employee's suitability for the role for which they have been recruited (Это дает Вам возможность оценить работника на соответствие занимаемой должности). A probationary employee will know that their work performance will be under review (В течение испытательного срока работник должен знать, что процесс выполнения его работы будет под контролем) and that they do not have a guarantee of ongoing employment (и что он не будет иметь никакой гарантии продолжения действия трудового договора).

However, there are many myths about probationary employment (Однако, полезно знать, что существует множество неправильных домыслов в отношении испытательного срока). This week, Charles Power is going to bust four of them (На этой неделе Charles Power собирается рассказать  о    4-х таких ).

MYTH: Probationary employees are exempt from Fair Work Act (FW Act) unfair dismissal laws (МИФ: В отношении испытательного срока не действуют положения Акта Должного трудоустройства  (ТД Акт) о недолжном увольнении) 

FACT: While under the FW Act's predecessor (Факт: В то время как предшественник ТД Акта), the Workplace Relations Act, (Акт Об отношениях на работе)  employees serving a reasonable period of probation were exempt from unfair dismissal laws (не распространял положения о недолжном увольнении на период действия испытательного срока), that exemption is not provided in the FW Act (ТД Акт не содержит данное исключение). 

Instead, there is a requirement that in order to make a FW Act unfair dismissal claim, the dismissed employee must have served a minimum employment period of 6 months (Вместо этого ТД акт предусматривает, что для подачи жалобы в соответствии с  ТД Актом о не должном увольнении  работник должен проработать минимум 6 месяцев) (or 12 months if the employer employs fewer than 15 employees) (либо 12 месяцев если в организации работает менее 15 работников). That is the case regardless of whether the employment contract includes a probationary or trial period (Описанная ситуация касается случаев когда трудовой договор включает условия либо об испытательном сроке либо о похожем правовом институте). 

MYTH: I don't have to give a probationary employee any notice of termination, or any reasons or warnings (МИФ: Наниматель не должен письменно оповещать работника в период испытательного срока о прекращении трудового договора, указывать причины увольнения либо предупреждать об увольнении заранее).

FACT: Many probationary clauses provide a lesser notice period for termination of employment during the probationary period (Часто случается, что условия об испытательном сроке, содержащиеся в трудовом договоре предусматривают  более короткий срок  уведомления работника о прекращении трудового договора)  as opposed to after the expiration of the probationary period (чем после окончания испытательного срока). However, the notice period for termination during a probationary period cannot be less (Однако, срок предупреждения работника о прекращении трудового договора в период испытательного срока не может быть меньше)  than the minimum periods prescribed in the National Employment Standards (NES) contained in the FW Act (чем срок, установленный в Национальном стандарте трудовых отношений, содержащегося в ТД Акте). The NES provides for 1-week notice for employees with less than 12 months' service (Данный Стандарт предусматривает недельный срок оповещения в отношении  работников, нанятых на срок более 12 месяцев). 

If a probationary period matches the minimum employment period (i.e. 6 or 12 months) (Если период испытательного срока связан с минимальным периодом найма (то есть 6 или 12 месяцев), the exclusion of unfair dismissal laws lessens your legal exposure (несоблюдение норм должного увольнения уменьшает правовые риски) if you dismiss before the expiration of the minimum employment period without a valid reason or warnings (если Вы уволили работника перед истечением минимального срока найма без уважительной причины либо предупреждений).

However, the dismissed employee can still challenge the dismissal on grounds (Однако, уволенный работник может после оспаривать увольнение на основании)  that it is in breach of anti-discrimination or general protection laws (того, что нарушены нормы анти-дискриминационного права либо общие права о гарантиях), or a breach of employment contract (либо положения трудового договора).

Therefore, if you decide to dismiss a probationary employee (Таким образом, если Вы решили уволить работника в период действия испытательного срока) you should still ensure (Вы должны быть уверены что) you are in a position to prove the reason for dismissal (Вы можете доказать причину увольнения) and show that it is a lawful reason (и сослаться на соответствующее положение законодательства).

You should also ensure that any probationary period clauses do not restrict your right to terminate employment during probation (Вы также должны быть уверены, что условия трудового договора об испытательном сроке не ограничивают Ваши права на расторжение договора в период испытательного срока). Avoid provisions in the employment contract that might entitle the employee to appropriate support (Избегайте также положений в трудовом договоре которые могут закрепить за работником права  на соответствующую поддержку) and a reasonable opportunity to demonstrate suitability for ongoing employment (и разумные возможности демонстрировать пригодность для постоянного трудоустройства).
