с договором принадлежат, обнаруженные сравнительно недавно, дорогущие останки
динозавров. Пара купила дом с земельным участком. Но по договору 2/3 часть
полезных ископаемых принадлежит бывшему собственнику земли. Как можно догадаться
в этой земле были найдены остатки динозавров, которое оценены в миллионы
долларов. И вот текст договора
“all right title and interest
in and to all of the oil, gas, hydrocarbons, and minerals in, on and
under, and that may be produced from the [ranch]”. Возник вопрос, являются
ли останки динозавров минералами (
minerals)? Суд первой инстанции установил, что с точки зрения
науки – да, являются. Но, сточки зрения текста договора – нет. Суд апелляционной инстанции возымел иную точку
зрения. Правда, один из судей имеет особое мнение, в пользу мнения суда первой
