Спор по поводу нарушений правил
доступности людей с инвалидностью в отношении прохождения вступительного
экзамена в одной из школ права, который начался в 2012 году, сейчас завершился
в фазе решения вопроса о возмещении юридических услуг. Данный вопрос изучался,
как я смог понять, достаточно тщательно. Ответчик занимал критичную
позицию
и в отношении количества часов,
и в отношении того, нужны ли были конкретные юридические услуги, и в отношении
стоимости часа услуг. Последний вопрос был связан соответственно с необходимой
квалификацией специалистов.

Апелляционный суд штата
Калифорния признал недействительным арбитражную оговорку в партнерском соглашении
из-за того, что: а) данная оговорка содержала соответствующие правила
по распределению расходов арбитража; б) данная
оговорка содержала соответствующие положения о конфиденциальности. В статье
Ex-Winston Partner Defeats Arbitration Bid in Gender Bias Suit можно, хоть и кратко, но прочитать, какова была суть этих
признанных недействительными положений. Как я смог понять, ознакомившись только
со статьей (не с судебным постановлением), причина была в том, что данные
положения не соответствовали законодательству. То есть законодательство дает
больше прав в данном случае для истца по делу. Иск вообще связан с дискриминацией
по половому признаку. Просто ответчик по иску заявил о существовании
арбитражной оговорки. Соответственно истец заявил о недействительности этой оговорки. Истцом же выступает работница юридической фирмы, которая
стала впоследствии партнером этой фирмы и подписала указанное выше партнерское
соглашение. Как
утверждает
истица
, she was unfairly passed over for work and
effectively forced out of the firm. Как точно это перевести не знаю,
наверное, дело в том, что ее, как она утверждает, незаконно перевили на другую
работу и, тем самым, устранили от работы в фирме.
