A divorce lawyer with a long-running conflict with a Fulton County Superior Court judge notched a victory—and a stern warning against judge-shopping—at the Georgia Court of Appeals last month.
A panel held that it was "constrained to agree" that Judge Bensonetta Tipton Lane did not follow the proper procedures when she refused to recuse from a case in which lawyer Lisa West was representing a party.
But the appeals court also indicated that West's practice of entering cases before Lane, then immediately demanding that the judge step aside because of their conflict, raises ethical questions and may violate ethics rules.
