14.11.2013 опубликован Протокол о взаимодействии Государственного
таможенного комитета Республики Беларусь и Министерства доходов и сборов
Украины в сфере таможенной статистики взаимной торговли, ступивший в силу
07.10.2013.

Протокол принят в целях реализации Соглашением о сотрудничестве и
взаимопомощи в таможенных делах от 15 апреля 1994 года и Соглашением между Правительством
Республики Беларусь и Кабинетом Министров Украины о
сотрудничестве и взаимной помощи в таможенных делах от 22 сентября 2000
года.
Протокол предусматривает, в частности, что:
- Стороны обмениваются в соответствии с законодательствами государств
Сторон данными
таможенной статистики взаимной торговли Республики Беларусь и Украины (далее – данные таможенной
статистики) на уровне первых восьми знаков товарных номенклатур
внешнеэкономической деятельности, используемых Сторонами, ежеквартально не
позднее 40 (сорока) дней с даты окончания квартала, а также по итогам года не
позднее 40 (сорока) дней с даты окончания года;
- на основании данных таможенной статистики, предоставленных в соответствии
со статьей 1 настоящего Протокола, каждая из Сторон проводит сопоставительный
анализ и по его результатам определяет субпозиции и подсубпозиции, по которым
имеются расхождения в данных таможенной статистики и в отношении которых
необходимо провести более подробный анализ в целях выявления причин таких
расхождений;
- Стороны обязуются использовать информацию, полученную в соответствии
с настоящим Протоколом, исключительно в таможенных целях. Она может
передаваться третьим лицам или использоваться для любых других целей только с
письменного согласия Стороны, передавшей эту информацию. Переданной
информации обеспечивается получившей ее Стороной такой же режим конфиденциальности,
который существует в ее государстве для информации аналогичного характера и
содержания в соответствии с национальным законодательством.
Среди дынных статистики, подлежащих обмену Протокол предусматривает, в
том числе, данные о (об):
- получателе (отправителе) товара, их адресах (Белорусская сторона
показывает украинских субъектов хозяйствования, украинская сторона –
белорусских субъектов хозяйствования);
- условиях поставки;
- стране происхождения товара;
- валюте контракта;
- стоимости в долларах США.

Documenting procedures and eliminating unplanned approaches to health and safety are a vital part of your legal responsibility to provide and maintain a safe working environment for anybody who enters your workplace, including contractors and visitors.
Safe operating procedures are a critical component of this responsibility to provide a systematic and organised approach to workplace safety.
A safe operating procedure is a written document that provides step-by-step instructions on how to safely perform a task or activity which involves some risk to health and safety. (A safe operating procedure is sometimes referred to as a safe work procedure or safe work method statement).
What to include in a safe operating procedure
Before beginning the process of developing safe operating procedures, you of course need to have identified the tasks that need a safe operating procedure. These tasks are referred to as critical tasks because they may pose a health and safety risk.
When writing your safe operating procedures, make sure you include the following things:
1. Basic steps: Divide each task into a number of operational steps, and then explain how each step should be carried out.
2. Safety procedures: Create explanations of how each step should be carried out which guides the user to carry out the task safely.
The safe operating procedure should be written in a way that gives the person undertaking the task complete information on the task without needing to refer to other resources.

Dear Reader,
In Wednesday’s bulletin, Charles Power gave us a rundown of a recent case in which an employee was dismissed via text message. The dismissal was found to be unfair by the Fair Work Commission (FWC).
Today, Charles will explain another case quite similar to the first (who knew it was so common to fire people via text message?). This case was found by the FWC to be one of the worst cases of unfair dismissal that they have seen! It shows us exactly why it is so risky to dismiss an employee via SMS.

In Kaye v Fahd and others (2013), a retail assistant had worked part-time on weekends for her employer for 19 years. In June last year, she received a text message from the business’s proprietor telling her that her services were no longer required: "I am no longer contracting to MCT as of today, therefore your services are not required with immediate effect. Regards Alex."

As we move further along into a hi-tech world, our social lives are changing. Now rather than calling someone, we often send a text message. But is it ok to use it as a principle form of communication for work matters? For instance, can you dismiss an employee via a text message?
As we move further along into a hi-tech world, our social lives are changing. Now rather than calling someone, we often send a text message. But is it ok to use it as a principle form of communication for work matters? For instance, can you dismiss an employee via a text message?
Technically, there's nothing wrong with this. But… as we know, when you dismiss an employee for misconduct or performance issues, you must go through certain procedures. I covered this in a bulletin in January, 'What you need to consider before dismissing an employee'. One of the most important things you must do before dismissing an employee is present them with the allegations and allow them an opportunity to respond. Is it really feasible to do this via text message?
Two recent cases show just how risky it is to dismiss someone via a text message. Charles Power will take us through the first one today, and the second one on Friday.

Проверки соблюдения требований технического регламента Таможенного союза

1-3 ноября надзорные органы Госкомитета по стандартизации планируют проведение на торговых объектах масштабных проверок на предмет соблюдения требований технического регламента Таможенного союза (ТС) о безопасности продукции легкой промышленности, сообщил БелаПАН минский предприниматель, член РОО «Перспектива» Вячеслав Пилипук.
Напомним, техрегламент ТС о продукции легпрома вступил в силу 1 июля 2012 года. Для поэтапного перехода к единым требованиям до 1 января 2013 года допускалось производство и выпуск в обращение на территории ТС продукции, не подлежавшей до вступления в силу техрегламента обязательной оценке (подтверждению) соответствия. В Беларуси для ИП — плательщиков единого налога этот период был продлен до 1 июля 2013 года.
Введение требований техрегламента ТС вызвало протесты ИП. Они заявляют, что, обязывая производить дорогостоящую процедуру сертификации товаров, власти ставят их на грань выживания. В конце июня — начале июля на рыках и в торговых центрах Беларуси прошли забастовки.
В результате три министерства — торговли, здравоохранения, сельского хозяйства и продовольствия — и Госкомитет по стандартизации приняли совместное постановление об оптимизации перехода к требованиям техрегламента. Документ упростил для ИП процедуру сертификации в соответствии с требованиями техрегламента при условии предоставления ими сопроводительных документов на товары.
До 1 ноября 2013 года Минторг и Госкомитет по стандартизации договорились не проверять реализуемые ИП товары легпрома на соответствие требованиям техрегламента. После этой даты предприниматели должны предъявлять сопроводительные документы, подтверждающие покупку товара на территории стран ТС.
Как сообщил Вячеслав Пилипук, 31 октября в «Перспективу» стали поступать тревожные звонки от предпринимателей из Молодечно, Барановичей, Светлогорска, Волковыска, Гродно и других городов страны. Звонившие рассказывали, что их массово приглашают в районные органы стандартизации.
«Там их предупреждают, что с 1 по 3 ноября в Беларуси запланирован широкомасштабный рейд на торговых объектах. Будет проверяться все, что касается техрегламента ТС по легкой промышленности. В Гродно работники Госстандарта и администраций рынка уже проводят проверку», — рассказал Пилипук.
По результатам проверок будут выдаваться предписания на устранение нарушений, а итоги рейда, по информации «Перспективы», будут обсуждаться на правительственном заседании 4 ноября.
По словам Пилипука, многие предприниматели решили не выходить на работу в течение трех дней проверок, поскольку боятся, что за предписаниями последуют штрафы и конфискации. «Многие люди говорят, что если надзорные органы после этого начнут применять к предпринимателям санкции, то они готовы остановить работу», — добавил представитель «Перспективы».
