Dear Reader,
Did you read about the recent workers' compensation claim that went to the High Court after an employee was injured during very private activities in a hotel room, while they were on location for a work purpose?
I'd be surprised if you didn't because it was controversial to say the least.
Today, Michael Selinger, Editor-in-Chief of the Health & Safety Handbook, explains what the result of this case really means for you in relation to liability for worker injuries and how far that liability extends.
While other cases have found that employers are liable, this case shows that perhaps the court will not extend the liability as far as we may have initially thought.

Proposed tax and super changes – what will stay and what will go?
Wednesday, 13th November, 2013, by Ana Cox
In today's Smart Tax Bulletin:
  • The new Government's position on Labor's proposed tax and super changes
Dear Reader,
Welcome to another edition of the Smart Tax Bulletin!
In today's edition, our Editor-in-Chief, John Kelly, will be taking a look at the status of proposed taxation and superannuation changes left hanging after Labor's loss in the Federal election.
When a new Government comes to power, there is always a period of clearing the decks and deciding what to do with the ousted Government's proposed legislative changes. However, in this instance, it would seem there was a larger than usual number of unfinalised tax and superannuation changes to deal with. The Coalition has therefore had a rather busy time deciding which measures to proceed with, what to get rid of, and what to seek further consultation on.
Read on for more from John about what has been decided so far, and the Coalition's intended deadline for resolution of all of Labor's proposed tax and super policy changes.
Until next time...

Dear Reader,

Documenting procedures and eliminating unplanned approaches to health and safety are a vital part of your legal responsibility to provide and maintain a safe working environment for anybody who enters your workplace, including contractors and visitors.

Safe operating procedures are a critical component of this responsibility to provide a systematic and organised approach to workplace safety.

A safe operating procedure is a written document that provides step-by-step instructions on how to safely perform a task or activity which involves some risk to health and safety. (A safe operating procedure is sometimes referred to as a safe work procedure or safe work method statement).

What to include in a safe operating procedure

Before beginning the process of developing safe operating procedures, you of course need to have identified the tasks that need a safe operating procedure. These tasks are referred to as critical tasks because they may pose a health and safety risk.

When writing your safe operating procedures, make sure you include the following things:
1. Basic steps: Divide each task into a number of operational steps, and then explain how each step should be carried out.
2. Safety procedures: Create explanations of how each step should be carried out which guides the user to carry out the task safely.
The safe operating procedure should be written in a way that gives the person undertaking the task complete information on the task without needing to refer to other resources.
A safe operating procedure must:

Why it is risky to dismiss an employee via text message - Part 2
Friday, 8th November, 2013
By Jessica Oldfield

In today's Workplace Bulletin:
  • Why it is risky to dismiss an employee via text message – Part 2
  • Case law 2: Dismissal via text message
Dear Reader,
In Wednesday’s bulletin, Charles Power gave us a rundown of a recent case in which an employee was dismissed via text message. The dismissal was found to be unfair by the Fair Work Commission (FWC).
Today, Charles will explain another case quite similar to the first (who knew it was so common to fire people via text message?). This case was found by the FWC to be one of the worst cases of unfair dismissal that they have seen! It shows us exactly why it is so risky to dismiss an employee via SMS.
Have a great weekend!

Case law 2: Dismissal via text message
By Charles Power
Editor-in-Chief, Employment Law Practical Handbook

In Kaye v Fahd and others (2013), a retail assistant had worked part-time on weekends for her employer for 19 years. In June last year, she received a text message from the business’s proprietor telling her that her services were no longer required: "I am no longer contracting to MCT as of today, therefore your services are not required with immediate effect. Regards Alex."
The Fair Work Commission found that there was no valid reason for dismissal and upheld the unfair dismissal claim.

Small business capital gains tax concessions - would you pass the test?
Friday, 8th November, 2013, by Ana Cox
In today's Smart Tax Bulletin:
  • Requirements for accessing small business CGT concessions
Dear Reader,
One of the more positive aspects of owning a small business are the small business capital gains tax (CGT) concessions, which can be accessed when selling a business or retiring.
The small business CGT concessions can provide significant tax relief when used correctly, but it's very important to make sure you meet the requirements before claiming them or you may be up for a significantly larger tax bill than you'd bargained for!
To make a claim a taxpayer must pass either the $2 million turnover test or the maximum net asset value (MNAV) test.
In today's edition of the Smart Tax Bulletin, our Editor-in-Chief, John Kelly, will take a look at a particular case in which one taxpayer didn't pass either test and paid the price for wrongly claiming small business CGT concessions.
Read on for more from John, to ensure something similar doesn't happen to you…
Have a great weekend!

A word of warning about the small business capital gains tax concessions
By John Kelly
Editor-in-Chief, Smart Tax HandbookThe small business capital gains tax (CGT) concessions are a wonderful thing, allowing small business owners tax relief when selling their business or retiring. However, as one taxpayer recently found out, the law governing these concessions is complex and the devil is in the detail.
You can only access the small business CGT concessions if you satisfy either:

The dismissing an employee via text message

Workplace Bulletin
Why it is risky to dismiss an employee via text message - Part 1
Wednesday, 6th November, 2013
By Jessica Oldfield

In today's Workplace Bulletin:
  • Why it is risky to dismiss an employee via text message - Part 1
  • Case law 1: Dismissal via text message
Dear Reader,

As we move further along into a hi-tech world, our social lives are changing. Now rather than calling someone, we often send a text message. But is it ok to use it as a principle form of communication for work matters? For instance, can you dismiss an employee via a text message?
Technically, there's nothing wrong with this. But… as we know, when you dismiss an employee for misconduct or performance issues, you must go through certain procedures. I covered this in a bulletin in January, 'What you need to consider before dismissing an employee'. One of the most important things you must do before dismissing an employee is present them with the allegations and allow them an opportunity to respond. Is it really feasible to do this via text message?
Two recent cases show just how risky it is to dismiss someone via a text message. Charles Power will take us through the first one today, and the second one on Friday.
Over to Charles…
