WASHINGTON, D.C. — The $930 million "patent trial of the century" between Apple Inc. and Samsung Electronics Co. could be heading back to U.S. District Judge Lucy Koh's courtroom for a little more tweaking.
A Federal Circuit panel posed searching questions for both sides Thursday, with a partial remand emerging as a possible outcome, as the trial that mesmerized Silicon Valley in 2012 went up on appeal in a mostly empty Washington courtroom.
Chief Judge Sharon Prost and judges Kathleen O'Malley and Raymond Chen of the U.S. Court of Appeal for the Federal Circuit sounded more or less satisfied with judgments of infringement on Apple's design and utility patents. But they appeared more skeptical when arguments turned to trade dress dilution, with O'Malley asking at one point how the court would guide Koh if "theoretically we were to send back" that portion of the case for retrial.
